Public Information Act Request Denied By Barbara Duncan In John Blasko Case


Good morning,

 

In response to your Public Information Act request received 5/16/2016, please be advised that due to the open and ongoing nature of the case, and pursuant to sections 4-343 and 4-351 of the General Provisions Article of the Maryland Annotated Code, your request for “any medical reports pertaining to the death of Mr John Blasko of Liberty street,” and “a copy of any reports of the chemicals that were found on mr Blasko's vehicle and in the home,” is hereby denied.


Please also be advised that pursuant to Sections 4-361 and 4-362 of the General Provisions Article of the Maryland Annotated Code, you may be entitled to review remedies under those sections of the law, and you may also pursue judicial enforcement remedies under those sections as well.



I will be having this reviewed by the Attorney General

What did you expect? You come on here complaining about the whole department and you wonder why you didnt get what you wanted. Nobody will give you anything if you complain about them all the time.

So basically what they are saying is that it is an ongoing investigation. The least they could do is to come out and say (or at least let the family know) that homicide is a possibility.

Did you ask for information into the robbery at Wendys a few weeks ago? Did you ask for the information from the shooting last week to see if it really was gang related? Did you ask for information on the murder in Princess Anne on May 2nd? you should ask for them as well

Hey 9:24....the truth hurts huh?????? JT is the only one trying to get some type of reply! SPD and Mayor are suppose to be PUBLIC SERVANTS....maybe they need to go back and read the freedom of information act....two idiots, neither qualified to due their respective jobs!!!!!

11:52 The Freedom of Information Act ONLY applies to documents controlled by the United States government so before calling someone else an 'asswipe' it would be prudent for you to know what you are talking about.

MD has what is called the Public Information Act and NO no one is "ENTITLED" to anything, so again before calling someone else an 'asswipe' it would be prudent for you to read the statues listed in the post as to why JT was denied.

Bottom line if this is an open investigation they don't have to turn over anything. I can understand the frustration of not knowing but to deny in this instance wouldn't be something that is unusual.
Has the family tried to request autopsy report from the state med examiners office in Balto?

I think the public has the right to know what this substance was that made the first cops responding sick enough to require medical treatment!

NO The public does NOT have a right to know, while the investigation is ongoing. There could be information that could jeopardize a potential criminal case. There could be information that only a participant in a crime IF, indeed there was anyone else involved would know.

Until the State's Attorney says, release the information, neither Jonathan or anyone else is going to legally get their hands on it.

Let it be known that I have the HIGHEST respect for JT and the service he provides the community. But the law is the law, and I know that JT knows that the authorities do have to fulfill his request if the investigation is still open.

I am sure that all will be made public in the fullness of time.

hey its 9:24 again, first if your going to attack me at least spell correctly. It makes your point less valid if you cannot spell. Due is a term used for payment, you meant to say do. Second, what does SBYnews have to do with anything? I didnt mention him at all. He has every right to copy and paste if he wants, just like JT has the right to be Magnum P.I. trying to solve crimes and be the hero.
