Kristy Hickman Record Challenged
Kristy Hickman is a very polarizing figure and the majority of her peers that I have asked about her do not like her and it has nothing to do with her being a woman, it has to do with her attitude. I want in the ending few weeks till the Election to focus more on her record and nothing personal as there is plenty of material out there for that.
I want to again visit the Smith Island school boat captain Capt Tyler who was charged with operating a school boat while under the influence by the coast guard and natural resources police. There were school children on the boat while capt Tyler was operating it under the influence of drugs and alcohol and Kristy turned the case over to Davis Ruark because evidently Kristy was friends with Capt Tyler.
Davis Ruark agreed to have the charges put on the Stet Docket. I want to ask you if you were under the influence of drugs and or alcohol and had school children on board would your charges be placed on the stet docket? This is the first in several cases we will be examining in the upcoming weeks.

Well then put Davis Ruark's picture up there because he is the one who stetted the case, not Hickman.
I just looked up the case. Read the docket entries for 19K10009321:
"State's Request For Postponement, Certificate Of Service, and unsigned Order
Of Court, filed. (Two witnesses for the State, Keith Neuman, who is permanently stationed now in Mobile, Alabama and Krystle Rodriguez, who is permanently stationed in Petalum, California, will not be available for said Motions)"
So to prove the motion to suppress, the coast guard needed to people flown in from Alabama and California. No wonder Ruark had to stet it. Sounds like the coast guard screwed that one up.

Natural resources Police officer Danny Tyler was on the scene and citations were issued by the state and could have been prosecuted. Plenty of witnessess were available and it was a matter of record that Capt Tyler failed the breathilizer test.
This was a pattern that occured over and over during the four years Hickman has been SA. I think it is good that the Grinch will be examining each case. This case was a joke and everyone knew from day one that Tyler would not get prosecuted because of the political connections. Don't forget Tyler had a prior DWI in 2007 and was still operating a school boat in 2010. This is no ones fault except Kristy Hickmans because the only reason she continued to give these kinds of cases to Davis Ruark is because she could control the outcome. Did she really think people in Somerset are so stupid that they can't figure out what she is doing? A little advice for Hickman would be to start prosecuting people instead of defending them, after all you are suppose to be a prosecutor. If you want to defend your friends, go into private practice.

Sounds like you agree with me 12:21, Hickman has no integrity. She will do anything not to offend any of her supporters (hard core dems). Fortunately there are always more good and honest people than there are corrupt politicians. Even the people of Smith Island are upset over this case and many former supporters of Hickman will be voting against her this time because of the Tyler cae.
Kristy will have all the air she needs once Dan Powell moves in. She screwed up....she needs to bend over and kiss her tush goodbye!

Grinch there seems to be a lot of that lately. I just heard that a high ranking Maryland Trooper son was arrested by the Sheriff's Office and Davis not only dropped the charges on the Troopers son but all his buddies as well. What the hell is going on around here. They will take days aaway from the cops who do not wear thier seat belts or hats on a call, yet they let some kid with beer and drugs walk because his daddy is at head quarters. I am sick of the whole freaking mess.
When this kid kills someone drinking and driving. I hope you all understand that political favors destroy the intent of the law.
I bet if his dad was a deputy or s.p.d officer the break would have not been given.
Glad to see Ruark leaving. All this kid learned is that he is untouchable because his father has political pull.
Why on Earth would Hickman give a dwi case to Ruark unless she wanted it to go away, this is the guy who has his own issues with a conviction for dwi and here we have Hickman giving him this case. It tells me everything I need to know about her judgement!

Who charged the kid and what is his name ?? I have not heard anything like this. I would love to hear the whole story 1:33. If you have details please provide them. My kid got a D.U.I. and he paid the price. This is the stuff that gives cops a bad name. It had to come from the top. I guess both counties have issues

I think that it is more than a coincidence that every case involving people that Hickman admits having a close relationship with gets turned over to Davis Ruark. Anyone with an ounce of common sense would learn that after Ruark mishandled one case after another the wise thing to do would be too turn the conflict cases over to another SA from another county. It's perfectly obvious to anyone that the ONLY reason to continue to use Ruark would be to get the results that she desired.
2:09, you say they are weak arguments. All of the cases were resolved in the same manner. It's public information if you don't believe it, just look it up. If you think justice was served you are in the minority. Since when can someone operate a school boat while intoxicated and the case gets put on the stet docket. The coast guard personel not being available for trial is just a smoke screen. Maryland laws were violated and a state police officer issued citations. What's your problem or what don't you understand?
I'm outraged that due to the actions of Hickman that Capt Tyler will be able to continue to operate the school boat. The board of education should weigh in on this situation and renegotiate the contract so that Tyler can no longer operate the school vessel. It's an almost unbelievable story but true.
She did exactly the same thing in the Henderson case 5:40. Hopefully Salisburygrinch will be doing a story on that botched case
The state police were not involved. It was the coast guard and NRP. If the offer was that out of order the judge in the case did not have to accept the offer. You can not really hang these on Hickman or her office.
I was on the boat a few weeks ago. He has lost his captain's license. For how long, I didnt ask. But he isnt allowed to run a boat. He's the deck hand right now. So he's been punished. I am not a relative or friend.
Wrong 6:22. Number one is that the NRP and State police are basically one and the same. Both have the same authority when it comes to enforcing any and all state laws. NRP happens to be the cops with the boats that can enforce boating and other fish and game laws. A DUI by NRP is absoslutly no different than one given by a MSP or town cop as far as that goes. Number two, the judge didn't have to go along but what is he suppose to do? It's really called prosecutorial discretion. The prosecutors can act like judge and jury when it comes to these kinds of cases. Fact is there should have been NO deal and they should have tried to get a conviction. If they lost the case so what, at least they tried. Problem is they don't want to try these cases because it would embarras there so called friends and supports that break the law.
This really isn't about Tyler, it's how Kristy Hickman handled the case. The only reason that he doesn't have his license is because the coast guard suspended them. If it had been all up to Hickman, Tyler would be sitting back up in the captains seat again.
If a commercial truck driver gets a DUI, he will never be able to drive a truck again. Why should a boat captain, especially one that carries children be able to so?
Not much punishment 6:43 when you own the boat and are making the same money and doing less work. By the way, I heard Tyler's sister is the captain now, how did she become a captain so quick after this incident? Just curious because she ran the family restaurant for many years and certainly wasn't a boat captain.
The answer to your original question Grinch is that I believe that if the average person was caught driving under the influence of drugs and alcohol with their own children in their own car they would receive some very severe punishment as they should. This story says a lot about the folks that we have elected over the past few years.
Hickman showed good ethics by handing off any case in which there could even be the appearance of impropriety. That's just ethics 101. Bottom line is that another office prosecuted this case, not Hickman. It's not on her. She didn't handle the case.

It would have been good ethics if Hickman would have handed it off without instructions as to what outcome she wanted. She used to defend Ruark but now it seems she wants to throw him under the bus. Since he lost the election he can't be of much use to her now. There was no good ethics in this case just like others that she handled in the same manner. Actually it was criminal the way she stayed involved even after admitting a conflict of interest.
Carrying school children under the influence of drugs and alcohol and this not the first time? Losing his captains license is not punishment. Its a walk. He'll never learn and get better from that kind of sentence. People commenting here keep saying he's a kid. He's an adult male in his mid to late 40s!

I dont know about the case but i know jimmy is doing something with that long hair blond girl that works with him. I have seen him and her 2 times in his own white personal pick up truck on the side of river road right down from my house.
As far as the Jimmy Henderson case I do know for A FACT that the MSP Homicide and the Feds could not find a thing on him. I have read the law suite and it has been dwindled down to nearly being non existent. This case was shown no favoritism by Kristy Hickman or Davis Ruark. I am sure any questions could be answered by the County Administrator at 410-651-0320. The campaign is between Kristy Hickman and Dan Powell, NOT Jimmy Henderson. Leave him alone and by all accounts he still should be Warden of the Somerset County Detention Center where he did a wonderful job. We are tired of hearing his name tied to all of this crap!!!
What about the lawsuit then? If he did nothing wrong they why is he not still the warden? He must have done something wrong.

After reviewing all threds it's clear to me that Hickman protected Capt Tyler. There was not one piece of evidence to suggest otherwise. If the SA office had any evidence to the contrary they would have come on here with facts. Bottom line for me is the Hickman arranged for Capt Tyler to only get a slap on the wrist and he will be back operating the school boat soon. When children get hurt or killed the blood will be on Hickmans hands.
Her kids don't have to ride the boat,they get to ride in mommy's county car on the way to their private school.
Another waste of taxpayers dollars 2:04. That SA budget really needs to be cut drastically.
